In Texas, a person whose blood alcohol content (BAC) is 0.08 percent or above is considered legally intoxicated. Additionally, drivers accused of DWI can face enhancements for extreme DWI, for a BAC of 0.15 percent or greater, or for driving with a minor age 15 or under in the car.
